Terms and Conditions of Service

Please read these Terms and Conditions carefully before ordering any products/services from SeekaHost. All contracts that SeekaHost may enter into, for the provision of the SeekaHost's services, shall be governed by these Terms and Conditions, and SeekaHost will ask their customer for the customer's acceptance of these Terms and Conditions if the customer use the https://seekahost-cloud-website.vercel.app/ website and buy domains names and/or web hosting services.
1. Introduction
1.1 These Terms & Conditions (“Terms”) govern your use of WebHosting.app’s hosting, domain, and related services.
1.2 By ordering or using any services, you agree to be bound by these Terms.
1.3 WebHosting.app may amend these Terms from time to time; changes will be posted on the website, and continued use constitutes acceptance of the updated Terms.
2. Definitions
"Service" means web hosting, domain registration, SSL, maintenance, or other services provided by WebHosting.app.
"Customer " or "you" means the individual or entity ordering or using the Service.
"Hosted Data" means your files, databases, content, and emails stored with WebHosting.app.
"Contract" means the agreement formed by these Terms plus your order.
3. Account Setup & Migration
3.1 WebHosting.app will commence service once your account is created, payment is confirmed, and any migration (if applicable) is scheduled.
3.2 If you request migration from another host, you must provide access credentials and all necessary files. WebHosting.app will use reasonable efforts to perform migration with minimal downtime, but does not guarantee zero downtime.
3.3 After migration, you should test your website and notify WebHosting.app of any issues within 7 days; after that, your approval will be assumed.
4. Hosting Services & Availability
4.1 WebHosting.app will provide hosting services for the agreed term (monthly, annually, etc.).
4.2 WebHosting.app uses reasonable efforts to maintain high availability (uptime), but does not guarantee 100% uptime. Maintenance or emergency work may result in temporary downtime.
4.3 WebHosting.app may suspend service if you violate Terms, fail to pay, or host illegal content.
5. Payments & Billing
5.1 You must pay all fees in advance according to the pricing and billing cycle selected.
5.2 WebHosting.app will issue invoices; you must pay by the due date.
5.3 If payment is late, WebHosting.app reserves the right to charge a late fee (e.g. 10% or fixed amount) or suspend services.
5.4 No refunds will be issued for suspension caused by non-payment.
5.5 Some services (domains, SSL) may be non-refundable once processed.
6. Data & Backups
6.1 You are responsible for maintaining backups of your Hosted Data. WebHosting.app may provide backup services, but they are a convenience, not a guarantee.
6.2 Upon termination, WebHosting.app will make available a copy of Hosted Data for a limited timeframe (e.g. 30 days), provided all outstanding fees are paid.
7. Acceptable Use & Content Restrictions
7.1 You must use the Service lawfully and not engage in spam, hacking, malware distribution, or violation of copyrights.
7.2 WebHosting.app may suspend or terminate your service if you host illegal content or violate these Terms.
7.3 You are responsible for content you upload, and you indemnify WebHosting.app from claims arising from your content.
8. Security & Malware
8.1 WebHosting.app will use standard security measures (firewalls, regular updates) but cannot guarantee complete protection.
8.2 If malware or hacking is detected, WebHosting.app may remediate at its discretion; remediation may incur additional charges.
8.3 You agree to cooperate with investigations into security misuse or abuse.
9. Confidentiality & Data Protection
9.1 WebHosting.app will keep your account and payment information confidential and only disclose to service providers or if required by law.
9.2 WebHosting.app and you agree to comply with applicable data protection laws (e.g. GDPR where relevant).
9.3 WebHosting.app may use sub-processors (e.g. data centers, payment processors) under binding confidentiality obligations.
10. Warranties & Disclaimers
10.1 WebHosting.app provides services "as is" and "as available."
10.2 WebHosting.app does not warrant uninterrupted or error-free operation.
10.3 You accept that you use the service at your own risk.
10.4 To the extent permitted by law, WebHosting.app disclaims implied warranties (merchantability, fitness for a particular purpose).
11. Limitation of Liability
11.1 WebHosting.app will not be liable for indirect, incidental, special, or consequential damages (e.g. loss of profits, loss of data).
11.2 The maximum liability of WebHosting.app for any claim will not exceed the total fees paid by you over the prior 12 months.
11.3 Liability for personal injury or death caused by negligence is not excluded.
11.4 WebHosting.app is not liable for delays or failures caused by events beyond its control (force majeure).
12. Indemnification
12.1 You agree to indemnify and hold WebHosting.app harmless from any claims, damages, or costs (including legal expenses) arising from your breach of these Terms or your content.
12.2 WebHosting.app may defend claims at your expense, and you must cooperate.
13. Termination & Suspension
13.1 Either party may terminate by giving notice (e.g. 30 days) after minimum term expires.
13.2 WebHosting.app may suspend or terminate services immediately for material breach, non-payment, or illegal use.
13.3 Upon termination, WebHosting.app may delete or retain Hosted Data according to the backup policy.
14. Governing Law & Dispute Resolution
14.1 These Terms are governed by the laws of the jurisdiction in which WebHosting.app is incorporated (e.g. England & Wales).
14.2 Disputes should first be attempted to resolve informally; if unresolved, parties submit to the appropriate courts.
14.3 WebHosting.app may seek injunctive relief anywhere, as needed.
15. Miscellaneous
15.1 If any provision is deemed invalid or unenforceable, the remainder will remain in effect.
15.2 You may not assign your rights under these Terms without WebHosting.app's consent.
15.3 WebHosting.app may assign or delegate its rights and obligations.
15.4 Failure to enforce a right does not waive it.
15.5 These Terms, plus any order agreements, constitute the entire agreement between you and WebHosting.app.
